Terms & Conditions

 

BINDING AGREEMENT:

These terms and conditions apply to all workshops you book with LA LUZ WORKSHOPS LLC (“LA LUZ”) and constitute a binding agreement between LA LUZ and each workshop participant (“Participant” or “you”). You should read these terms and conditions carefully. If you do not agree with any part of them, you should not book a workshop with LA LUZ.

WORKSHOPS:

LA LUZ provides educational photography workshops (each a “Workshop”). Tuition is for the Workshop only. LA LUZ is not responsible for planning or booking any other aspect of Participant’s travel to and from the Workshop, lodging, etc. 

The itineraries and staff presented in this website are subject to modification and change by LA LUZ at any time. Every reasonable effort will be made to operate programs as planned, but alterations may still occur. 

You acknowledge that no portion of Workshops may be recorded.

If you have any problems or complaints during the Workshop, you must communicate the same to LA LUZ promptly so that LA LUZ may attempt to resolve them in whatever manner LA LUZ, in its sole discretion, deems appropriate. Any such communication may be directed to selma@laluzworkshops.com

PAYMENT:

Full tuition is due upon acceptance into the Workshop. Tuition must be paid in full in order to confirm your place in a Workshop.

Depending on the specific class, payments can be made by check, wire transfer, PayPal or Stripe. Tuition and any other amounts due hereunder are reflected in United States Dollars (USD) unless otherwise noted. 

If you choose to use PayPal, please note that any commissions will not be returned to you in case of a refund.

CANCELLATION:

We rely on your attendance to make important arrangements and logistical preparations. If, for any reason, you must cancel your enrollment or participation in a Workshop, please notify LA LUZ in writing by email to selma@laluzworkshops.com as soon as possible. Your cancellation notice will be effective as of the date the email is received by LA LUZ and will be subject to the following tuition & refund policy:

For Online Workshops (including Lecture Series, Seminars and Symposiums):

-Participation is confirmed upon receipt of full tuition.

-Cancellation notice received 61 days or greater prior to the starting date of the Workshop, will be charged a $75 USD administrative fee.

-Cancellation notice received between 31 to 60 days prior to the starting date of the Workshop, will be charged 50% of the tuition for the Workshop.

-Cancellation notice received between 0 to 30 days prior to the starting date of the Workshop, will be charged 100% of the tuition for the Workshop.

-Cancellation at any time while the Workshop is in progress, for any reason whatsoever, will be charged 100% of the tuition for the Workshop. No refunds will be made for unused portions of a Workshop under any circumstances.

-The nature of online instruction means that there may be instances of lost connection or technical difficulties beyond La Luz’s control and participants may not seek a refund due to any such interruptions.

-Two weeks prior to the starting date of a Workshop, enrolled participants will receive a document including information to get ready for the Workshop.

For Course Recordings:

-Access to recordings is granted upon LA LUZ’s receipt receipt of payment.

-No refunds will be made under any circumstances once payment has been completed.

-Access is available until the deadline specified in the course description.

For International Workshops:

- Your enrollment in a Workshop will only be complete upon LA LUZ’s receipt of the full Tuition for the Workshop.

- Final payment is due no later than 120 days prior to the starting date of the Workshop.

- Cancellation notice received between 90 to 119 days prior to the starting date of the Workshop, will be charged 50% of the tuition for the Workshop.

- Cancellation notice received between 60 to 89 days prior to the starting date of the Workshop, will be charged 75% of the tuition for the Workshop.

- Cancellation notice received between 0 to 59 days prior to the starting date of the Workshop, will be charged 100% of the tuition for the Workshop.

-Cancellation at any time while the Workshop is in progress, for any reason whatsoever, will be charged 100% of the tuition for the Workshop. No refunds will be made for unused portions of a Workshop under any circumstances.

-Sixty days prior to the starting date of a Workshop, enrolled participants will receive a document including a detailed destination guide, and information to get ready for the Workshop.

For U.S. based workshops:

- Your enrollment in a Workshop will only be complete upon LA LUZ’s receipt of the full Tuition for the Workshop.

-Final payment is due no later than 90 days prior to the starting date of the Workshop.

-Cancellation notice received between 89 to 60 prior to the starting date of the Workshop, will be charged 50% of the tuition for the Workshop.

-Cancellation notice received between 59 to 30 days prior to the starting date of the Workshop, will be charged 75% of the tuition for the Workshop.

-Cancellation notice received between 0 to 29 days prior to the starting date of the Workshop, will be charged 100% of the tuition for the Workshop.

-Cancellation at any time while the Workshop is in progress, for any reason whatsoever, will be charged 100% of the tuition for the Workshop. No refunds will be made for unused portions of a Workshop under any circumstances

-One month prior to the starting date of a Workshop, enrolled participants will receive a document including a detailed destination guide, and information to get ready for the Workshop.

There are no exceptions to this cancellation policy for any reason, even in the event of a medical emergency. In order to avoid incurring in the above cancellation charges, we strongly recommend the purchase of Trip-Cancellation/Interruption Insurance.

If you do not pay your tuition on time, LA LUZ has the right to cancel your reservation for the Workshop. LA LUZ has the right to cancel your reservation for the Workshop. You agree that LA LUZ will have no liability for any such cancellation.

LA LUZ reserves the right to cancel any Workshop because of inadequate enrollment that makes the trip economically unfeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If LA LUZ elects to cancel a Workshop for either of these reasons, you will receive a full refund and/or credit equivalent of any tuition you have already paid to LA LUZ. Similarly, if LA LUZ cancels a Workshop after it has commenced, you will receive a prorated refund based on the number of days not yet completed. 

Notwithstanding the foregoing, LA LUZ will not be liable for any forced delay in, change to, or cancellation of one or more Workshops due to any event of Force Majeure, or any other circumstance beyond the reasonable control of LA LUZ including, but not limited to war, threat of war, riot, civil strife, terrorist activity, industrial dispute, disease, industrial or nuclear disaster, adverse weather conditions, fire, and strikes. 

In no event will LA LUZ be responsible for any other expenses you may have incurred in association with the Workshop such as airline tickets, hotel reservations, etc. We strongly recommend that all participants purchase Trip-Cancellation/Interruption Insurance that covers Workshop expenses and non-refundable travel costs. Although LA LUZ makes no guarantees, we recommend that you check on your Workshop status before purchasing anything that is non-refundable. 

RECOMMENDATIONS:

At your request, LA LUZ may, as a courtesy, and at no additional charge, make one or more suggestions or recommendations during the Workshop regarding any number of things, including lodging options, restaurant options, local translators, locations or subject for photography, etc. By making such request of LA LUZ, you expressly acknowledge and agree that you assume sole and exclusive risk and/or liability associated with following any such suggestions or recommendations. 

SUITABILITY TO PARTICIPATE:

You must be in good physical and mental health to participate in a Workshop. Any physical condition, diet, or treatment requiring special attention or for which you require assistance or accommodation must be reported in writing when the reservation is made. LA LUZ will keep confidential any such personal or medical information you share with LA LUZ, and will only use the information to the extent needed to coordinate your successful participation in the Workshop. We strongly recommend that you purchase international medical insurance for the duration of the Workshop. 

Minors must be accompanied by an adult in order to enroll in or attend a Workshop. You are solely responsible for assessing the following for yourself and any minor(s) you accompany: (i) whether you are in good enough health and fitness to travel to and from, and to participate in a Workshop; (ii) whether you are legally able to travel to and from, and to participate in the Workshop. 

TRAVEL DOCUMENTS:

All participants are responsible for ensuring they have the proper travel documents (including, but not limited to, valid passport and visa(s)). Each participant MUST CHECK with the respective consulates, visa agencies, and other regulatory bodies to determine whether any visas or other travel papers are required. Most countries require that passports be valid for at least 6 months beyond the conclusion of the trip. It is recommended that you have a minimum of six blank pages in your passport when traveling, as many countries require blank pages. 

COMPLIANCE:

LA LUZ requires that you follow all laws, rules, and regulations of the locations whether the Workshop is held. If your actions interfere with the safety and well-being of yourself, any other participant, or any LA LUZ owner, employee, or agent, LA LUZ reserves the right to terminate your enrollment in the Workshop and to require you to leave.  

LIMITATION OF LIABILITY:

Your total remedy, if any, for any injury and/or damages you may suffer arising from or connected in any way with a Workshop is limited to the total amount you have paid for the Workshop. LA LUZ will not be liable for any indirect, special, incidental, or consequential damages of any kind regardless of the form of the action and even if LA LUZ has been advised of the possibility of such damages. Participant expressly waives any right Participant may have to recover such damages. Further, Participant acknowledges that LA LUZ shall have no liability for any injury and/or damages sustained by a Participant from a third party that Participant may have been introduced to or met via the Workshop.

LIKENESS RELEASE:

Unless you direct LA LUZ otherwise prior to a Workshop, LA LUZ may capture and use your likeness by photograph or otherwise. 

CHOICE OF LAW:

These terms and conditions, along with any applicable Workshop Agreement, are governed by the laws of the State of Minnesota. You agree to the exclusive venue and personal jurisdiction of the courts situated in Hennepin County, Minneapolis, MN. LA LUZ may change these terms and conditions at any time. It is your responsibility to review them frequently.
